Packaging Regulations

The Producer Responsibility Obligations (Packaging Waste) Regulations 2007 place obligations on UK businesses who have a turnover of over £2 million and who handle over 50 tonnes of packaging. Companies are required to register with the appropriate Agency - Environment Agency (EA) in England and Wales, the Scottish Environmental Protection Agency (SEPA) or the Northern Ireland Environment Agency (NIEA), alternatively they may choose to register with an approved Compliance Scheme who can take on some of their legal obligations.

In order to demonstrate compliance with the regulations, businesses are also required to calculate the amount of packaging they handle (import, manufacture, pack, or sell) and from this determine how much evidence they must purchase in the form of Packaging Recovery Notes, known as PRNs.

Whilst businesses required to comply with these regulations can pass on some of their legal obligations to a compliance scheme, the obligation to report accurate packaging data remains with the business itself.
