June 2011: Extension of Food Waste Regulations

The Waste Management (Food Waste) Regulations 2009 which came into effect from 1st July 2010 are about to be expanded to include all businesses that are producing food waste.

The Regulations are intended to impose obligations on the main generators of food waste including shops, supermarkets, forecourts, state buildings, restaurants and cafes, hot food outlets, canteens, hotels and large guest houses. Previously small businesses producing less than 50 kgs of food waste per week could send a written declaration to their local authority to get an exemption from the Regulations but this derogation is due to expire on July 1st 2011.

Key Obligations for Businesses

Obligated producers need to ensure that food waste is kept separate from other waste streams. This prevents it becoming contaminated and unsuitable for recycling. The legislation also prevents segregated food waste from being disposed of by being sent to landfill.

A business that is subject to this legislation has a number of options for its segregated food waste.
